These terms are the agreement between you and Quietra for using the Quietra iOS app. By downloading or using the app, you agree to them. Please read them alongside our Privacy Policy and Subscription Terms.
1. The app and what it is for
Quietra plays sound to mask the ringing of tinnitus so it is easier to rest. It is a comfort and rest tool. Quietra is not a medical device, and it is not a substitute for professional care. It is not a replacement for advice from a doctor or audiologist. If the ringing in your ears is new, sudden, one-sided, or comes with dizziness or hearing loss, please see a qualified professional.
2. Your license
We grant you a personal, non-exclusive, non-transferable, revocable license to use Quietra on Apple devices you own or control, for your own personal, non-commercial use, in line with the App Store Terms of Service and the standard Apple Licensed Application End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula. Where those Apple terms and these terms differ, the Apple terms govern your use of the App Store copy of the app.
3. Acceptable use
You agree not to:
- copy, modify, reverse-engineer, or resell the app except as the law allows;
- use the app in a way that could harm your hearing — keep the volume comfortable and low;
- use the app while doing anything that requires your full attention, such as driving;
- use the app for any unlawful purpose.
4. Hearing and safety
Sound played too loud or too long can affect your hearing. Set the volume no higher than you need to make the ringing comfortable, and give your ears breaks. If any sound is uncomfortable, stop using it. You are responsible for the volume levels you choose.
5. Intellectual property
The app, its name, design, and content are owned by Quietra or its licensors and are protected by law. The soundscapes are used under the licenses of their creators. Your journal and other content you create remain yours.
6. Subscriptions
Some features require a paid subscription. Pricing, the free trial, renewal, and cancellation are described in our Subscription Terms, which form part of this agreement.
7. Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the app will be uninterrupted, error-free, or that it will produce any particular result for your comfort or sleep.
8. Limitation of liability
To the fullest extent permitted by law, Quietra will not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the claim.
9. Apple as a third-party beneficiary
Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
10. Changes and contact
